In Focus: A new Digital India Act in the works
Right on the heels of the news of withdrawal of the Personal Data Protection Bill in Parliament by the Government, news has emerged that a new legislation, known as the Digital India Act, is expected to be tabled before the Winter Session of Parliament later this year.
The Digital India Act (DIA) is expected to be a comprehensive legislation that will replace the existing Information Technology Act, 2000 which is over two decades old and is viewed as obsolete in light of the rapid technological progress. It is expected to cover various focal points of digital regulation, such as data protection and privacy; social media; over-the-top (OTT) platforms; introduction of additional offences and so on. It is also rumoured that the DIA will include some baseline regulations for blockchain, cryptocurrencies, Web 3.0, metaverse, and 5G. Based on available reports, it is quite clear that the target group whom these regulations are aimed at (and will impact the most) is Big Tech - Google, Amazon, Facebook, Twitter, Netflix and the like.
On data protection, it has been reported that the Government of India is looking closely at the European Union’s Global Data Protection Regulation (GDPR) as a template for India’s own regulations. The Government is also mulling the possibility of asking big tech companies to share anonymised data with start-ups who could analyse and use it for their future products.
For OTT platforms, although the Government of India already has a self-regulatory structure in place, it has been reported that the DIA will bring OTT platforms under regulatory scrutiny in respect of their content. The law is likely to empower concerned authorities to direct platforms to pull down content that violates guidelines or spreads misinformation.
Social media is also in for a big regulatory overhaul. Amongst other regulations associated with data protection and monetisation, the DIA will reportedly empower the Government to block any Facebook page or Twitter handle temporarily for 24 hours if it is found to be disseminated misleading information or inciting violence.
Given the ambitious target that the Government has set for itself, it is fair to assume that the draft legislation has made significant progress. However, with the high level of secrecy surrounding this crucial task, it cannot be said for certain that India will have a new digital law by 2023.

Payment aggregators urge RBI to reconsider new guidelines
Payment aggregators are approaching the RBI via their industry body, Fintech Association for Consumer Empowerment (FACE), to secure a relaxation of new guidelines which have effectively rendered them obsolete in the digital lending industry. In most digital lending (and buy now pay later) arrangements, loans are first disbursed to a nodal account, from whereon payment aggregators route money to the customers account.
Under the new guidelines, the role of credit intermediaries has been completely eliminated. All lending transactions are required to be only executed between the bank accounts of the borrower and RBI regulated entities without any pass through of any third party. Any processing fees, charges, etc. previously payable to intermediaries will now have to be borne by the digital lender and not the borrower. In addition, the lenders will also be required to disclose an all inclusive cost of the digital loan in the form of an Annual Percentage Rate (APR) up front.
While formulated in the interest of consumer protection, these guidelines will slow the growth of the digital lending industry in the short run. According to FACE, fintech lending companies disbursed a total of 2.66 crore loans worth Rs. 18,000 crores in FY 2021-22.
India inaugurates its embassy in Asuncion, Paraguay
India’s External Affairs Minister Dr. S. Jaishankar is currently on a tour of three major Latin America countries, Brazil, Argentina and Paraguay. This is the EAM’s first official visit to South America, aimed at boosting overall bilateral ties.
As the first visit by an Indian External Affairs Minister to Paraguay, the visit, which marked 60 years of diplomatic relations between New Delhi and Asunción, was of great significance. The visit saw Dr. Jaishankar inaugurate India’s newest embassy in the Latin American country. Until now, the Indian Embassy in Argentina's capital Buenos Aires was handling political relations with Paraguay.
Speaking on the occasion, Jaishankar expressed certainty that with the opening of the embassy, opportunities for cooperation between the two countries would increase. The opening of the embassy is line with the MEA’s project of increasing its global footprint, under which an embassy was opened in Estonia last year and approval to open an Embassy in Lithuania has also been recently granted.
CCI turns its attention to PE board seats in rival firms
The Competition Commission of India is reportedly keeping a watch on private equity firms that hold board positions in competing firms. While the regulator does not take issue with PE firms holding minority stakes in competitors, it is directing them to limit board representation to a single firm, citing competition concerns. Notably, the CCI has been studying ownership of PE investors since December 2020, and its new approach seems to be the culmination of this project.
This is not the first time that the issue has received attention from regulators. The European Commission dug into the phenomenon in 2020, finding it challenging to detangle the complex pattern of holdings and flagging it as an area of future research.
The move measures a wider discomfort around competition concerns that can arise in an ecosystem from the influence of third parties. The Competition (Amendment) Act, 2022, recently introduced in the Lok Sabha, also introduces the idea of ‘hub and spoke cartels’ - where collusion between competitors is facilitated by a third party - to Indian antitrust law.
